The TPP: A Quiet Coup for
the Investor Class
The Obama administration's
trade negotiators are quietly selling out workers and the environment in a
massive Bush-style trade agreement.

It would be a relief to report with any certainty that the
negotiations over the Trans-Pacific Partnership (TPP)—a massive proposed
free-trade zone spanning the Pacific Ocean and all four hemispheres—are
definitely empowering corporations to the detriment of workers, the
environment, and sovereignty throughout the region. Unfortunately, the
secretive and opaque character of the negotiations has made it difficult to
report much of anything about them.

What can be confidently reported about the TPP is that, in
terms of trade flows, it would be the largest free-trade agreement yet entered
into by the United States—and, according to a report by the Congressional
Research Service, that the ministers negotiating the agreement “have expressed
an intent to comprehensively reduce barriers in goods, services, and
agricultural trade as well as rules and disciplines on a wide range of topics”
to unprecedented levels. Yet despite these grandiose ambitions, details of the
negotiations and drafts of the text have been purposefully withheld from
Congress and American citizens.

The secrecy surrounding the negotiations is breathtaking. In
July, 134 members of the House of Representatives sent a letter to U.S. Trade
Representative Ron Kirk requesting that the appropriate congressional
committees be consulted and that a draft of the text be released. The members
reminded Kirk that draft texts were circulated and congressional committees
consulted throughout the NAFTA negotiations in the early 1990s. Their letter
received no response. A month later, House members petitioned Kirk to allow a
congressional delegation to observe the negotiations—as in the Uruguay Round of
the General Agreement on Tariffs and Trade, the launch of the Doha Round of the
World Trade Organization, and numerous NAFTA rounds. Despite its persistence,
Congress has not been granted any significant oversight or insight regarding
the negotiations.

While Congress, the press, and the public have had to make
do with leaked chapters of negotiations, Just Foreign Policy reports that 600
corporate lobbyists were granted access to the negotiated text. American
democracy is in a sorry state when corporations are granted more access to even
the text of sweeping government agreements than the public and its elected
officials. Although corporate influence on U.S. trade policy is hardly a new
phenomenon, the simultaneous waning of congressional oversight is all the more
unsettling.

In May, Democratic Reps. Barney Frank and Sander Levin wrote
to Treasury Secretary Timothy Geithner to express their concern about the TPP’s
provisions entrenching capital mobility. Their letter requested “an official
written statement of the U.S. policy” concerning the ability of parties to the
agreement to deploy capital controls in the face of a financial crisis. If the
leaked drafts accurately reflect the direction of the negotiations, countries
that instituted capital controls could be taken to court by private
corporations and could be held liable for damages. Hundreds of economists
signed letters in January and February 2011 opposing these provisions, yet the
investment chapter leaked in June suggests that neither their concerns nor
Frank’s and Levin’s were taken into consideration.

Other troubling trends have emerged in the leaked chapters.
According to Citizen.org, the negotiations thus far have given corporations the
right to avoid government review when acquiring land, natural resources, or
factories. They have also banned corporate performance requirements, guaranteed
compensation for the loss of “‘expected future profits’ from health, labor,
[or] environmental” regulations, and included stunning provisions concerning
the right to “move capital without limits.” If these are indeed terms of the
TPP, then the agreement would make it nearly impossible for countries to hold
corporations accountable for their conduct—and would in fact hold governments
liable for any “damage” incurred by corporations due to the institution of
regulations.

Many progressives had hoped that President Barack Obama
would shift U.S. trade policy away from staunch free-marketeering. But
according to Lori Wallach, the director of Public Citizen’s Global Trade Watch,
the leaked chapters of the TPP “sent shock waves through Congress because it
showed that U.S. negotiators had totally abandoned Obama’s campaign pledges to
replace the old NAFTA trade model and in fact were doubling down and expanding
the very Bush-style deal that Obama campaigned against in 2008 to win key swing
states.”

The struggle over the Trans-Pacific Partnership reveals a
disturbing trend in American politics. The much discussed Citizens United
ruling granting corporations personhood has given way to a trade negotiation
process in which corporations are granted more rights than American citizens,
their elected representatives, or foreign governments impacted by the deal.
That trade negotiations with such an immense potential impact on numerous
sectors of the American economy have been conducted in secret is troubling enough.
To consider that those negotiating the treaty have willfully ignored experts
and elected representatives in favor of corporate interests calls into question
the sustainability of American democracy.

It takes a Democrat to really
screw over working people. The Democratic base would never have let a
Republican president get away with what has been the most devastating trade
agreement for working people: NAFTA. That took Clinton. Now, TPP, or NAFTA on
steroids, will be put into place by Obama.
This is the real problem with
lesser-evil-ism: it is not so much that people vote for Democrats, it is that
when elected the Democratic base believes that the Democratic Party will act
meaningfully different than the other ruling class party. The Democratic base,
who are often politically engaged or active when the GOP is in power, become
passive when the Dems are in power. Hence, the appropriateness of Glen Ford's
(Black Agenda Report) aphorism: "not the lesser-evil, but the more
effective evil."
If the base of the Democratic
Party pushed as hard on the Democratic politician's bad policies as they do on
Republican's bad policies, things would be a significantly better in this
country.

Thinkputz
It is a continuation of a coup
that has been going on for a long time. Maybe if college students like Ms.
Matfess are noticing this, there will be fewer of them out looking for high
paying corporate yuppie jobs and will begin to steer things toward more humane
goals. There may not be time, but Ms. Matfess and people like her do inspire
smidgens of hope.

This is fascism plain and simple
- at least if the word has any meaning whatsoever any more.
And in fact it codifies a 2 tier
legal system - anything goes for the corporations and stringent laws and hefty
fines for persons who enage in 1/10th the behavior that would be legal for the
corporation.
Obama is proving to be No Lesser
of an evil mo fo - more effective and just as psychotic as the bush dementors
or the Romney fascists.
Anyone who votes for Either of
the the 2 main parties is freaking crazy.

Gotta agree. It is unadulterated
corporate usurpation of governmental power (the power of a people's
commonwealth, the purpose of government). If this is the real setup of TPP,
totally over the top. Shocking shock capitalism, pure might makes right. Scary.
Section 1021 of NDAA, the military's right to detain citizens without charge
indefinitely. Scary, scary stuff. (And the list really goes on, doesn't it). At
this point, it seems like Democrats will vote for Obama purely because he will
offer greater protection of social programs (and even on these he has to be
watched like a hawk for craven concessions!) and women's health (that this is
even an open political issue is a dastardly besmirch upon the GOP). And I agree
these are important reasons to "agree" with him. But when I look upon
his record everywhere else, he is evincing strong government concession to
corporate power, market and industry after market and industry, and continuing
an overtly warmaking foreign policy that is razing justice and raining murder
worldwide. The world is so small now, should be obvious that peace is the only
answer. As a species, we should now be able to recognize, from this grand view
of history (of humans, of the earth) up to now, that our numbers, every one of
us, is a very rare thing in this vast universe (even if "earths" are
like dandelions). This view should unify us, the current states of affairs
should make us realize that life on earth is very fragile. Our great unifying
economy should be an effort to preserve spaceship earth while simultaneously
learning to fly from it, thrive away from it. That sounds far out, but it's
right here, now. Either we join a great common purpose, it seems, or the
species, we, may all fail.

Too bad only a small minority of
Americans know this story. This is just the continuation of the neoliberal
policies that have screwed over working class Americans and enriched a small
minority of plutocrats. The government is run for the benefit of the few at the
expense of the many and will continue to be until people stop cooperating. I
wonder what level of suffering will finally trigger the revolt that is
inevitable? I hope the billionaires and multi-millionaires enjoy sleeping on
their piles of money. For now.

One of the big problems here is
mindset. Rational people, looking at the pending disaster of global warming
would say, "We've got to get together and try to reverse this before it is
too late!" (It may be)
The Oligarchy looks at impending
doom and says, "It looks like the world is coming to an end. I'd better
grab what I can before it is all gone."
I think they are tied to the old
dictum, He who dies with the most toys wins.

I look forward to the day when
the US economists who almost unanimously promoted "free trade" as
unquestionable dogma, are replaced by cheaper foreign economists as has
happened to so many of the rest of us thanks to their ideology.

WTO. Corporations triumphed over our protests when Mr. Clinton was president.
They will make a clean sweep with TPP. Why do you think the World Trade Center
was destroyed? Free Trade is not Fair Trade.

I was pretty sure I have read several articles about how NAFTA added wealth to
the US economy as a whole, mostly at the top incomes with higher investment
returns. If that is the case, I believe we can just tax and spread that money
back out and would also be able to with any trade agreement that benefits the
nation. As far as environmental concerns go, I would like to hear how we can
negotiate away from the current "worst environment wins" model. Paul
Krugman gave a talk in China that was about this, but I can't find it anywhere.

should be taxed are the ones who bought the Executive, Legislative and Judicial

Increasing taxes on the 1% has been repeated by the Obama
administration and has been a central issue in their negotiations with
Republicans. BO has made increasing their tax rates a line in the stand. Sounds
like a guy, with the positive economic data that will follow increasing the 1%
taxes, that will be able to challenge the counterintelligence about tax policy
that is continually puked out by the right. So what I'm saying is, mini, you're
oversimplifying the issue. Let's pretend for a bit that Armageddon and
conspiracy theories are just for people who are mentally lazy. We have work to
do, plans to make and chaos to sort through. Fatalistic attitudes are not
useful.

Obamanation continues. There is not too much left to give away, but he'll have
four years to do it, along with another four or five wars.
